§ 2-80. Return of village property by former village officials.

  • (a)

    Within five days after written notification and request, a person who has been an officer of the village shall deliver to the successor in office all property, books and effects in the former officer's possession, belonging to the municipality. Notification can be given by either the village president, village clerk or village attorney by certified mail or personal delivery.

    (b)

    It is the duty of each person who has been an officer of the village to return all village property as described in subsection (a) of this section and sign an affidavit swearing the property being returned constitutes all village property which has been in the former officer's possession belonging to the municipality. The affidavit shall be signed by the former officer and notarized before a qualified notary public.

    (c)

    A former officer who violates this section is liable for all the damages caused by the violation. In addition, a former officer who violates this section shall not receive that officer's last payment of compensation due from the village nor shall said officer receive any other benefits to which a former officer may be entitled until all such property and the required affidavit is returned to the village.

    (d)

    In addition to the other sanctions imposed by this section, any former officer who violates this section is subject to a penalty as set forth in section 1-8.

    (e)

    In addition to the other sanctions imposed by this section, a former officer who violates this section shall be considered to be indebted to the village so as to make them ineligible for elective municipal office pursuant to section 3.1-10-5 of the Illinois Municipal Code (65 ILCS 5/3.1-10-5).
