Chapter 54. PEDDLERS AND SOLICITORS |
Article III. SOLICITORS |
§ 54-57. Permit applications.
(a)
Commercial solicitation permits. An application for a commercial solicitation permit shall contain the following information regarding the applicant.
(1)
Full name as it appears on a drivers license, state I.D., social security card or birth certificate, birth date and address of present place of residence, length of residence at such address and social security number.
(2)
Address of place of residence during the past three years, if other than present address.
(3)
Physical description of the applicant and make and license number of the applicant's automobile used during soliciting.
(4)
Name and address of the person, firm, corporation or association with whom the applicant is employed or represents and the length of time of such employment or representation.
(5)
Description sufficient for identification of the subject matter of the soliciting which the applicant will engage in.
(6)
Information as to whether a solicitation permit has been previously issued to the applicant, and if so, whether the permit was ever revoked.
(7)
Information as to whether the applicant has ever been convicted of a violation of any of the provisions of this article.
(8)
Information as to whether the applicant has ever been convicted of the commission of a felony under the laws of this state or any other state or federal law of the United States, or misconduct which constitutes a class A misdemeanor involving dishonesty or false statement under state law or similar violation in any other state, within five years of the date of the permit application.
(9)
Illinois Retail Sales Tax Identification Number, if applicable.
(10)
Where the solicitation will be conducted on streets or highways a certificate of insurance issued by an insurance company licensed to do business in the state shall be provided, insuring the solicitors and their organization and the village, its officers and employees for liability for damages for personal injury and property damage causally related to the acts of the soliciting agent. The certificate must state that it shall not be canceled during the period of solicitation and will provide at least the following coverage:
a.
Personal injury, $500,000.00 per person.
b.
One million dollars per occurrence.
c.
Property damage, $100,000.00.
The certificate shall also identify the village, its officers and employees as additional insured parties under the policy effective during the entire period of the solicitation permit.
(b)
Charitable solicitation permits. An application for a charitable solicitation permit shall include or be accompanied by the following:
(1)
The name and address of the organization making the application and the name under which it intends to solicit contributions.
(2)
The name and address of the person in charge of solicitation in the village.
(3)
The names and addresses of all the persons who will solicit contributions in the village.
(4)
Such additional information which the village administrator may from time to time require to verify that persons who will solicit contributions are eligible for a permit under this article.
(5)
The dates and times of day such solicitations are to be made and the geographic area in the village wherein such solicitation shall be conducted at a particular time and day, provided that the maximum time period for which the permit shall be issued shall not exceed 30 days, and provided that permit renewals shall not exceed 30 days.
(6)
A written statement of recent date by the state attorney general that the organization is in compliance with the provisions of the "Solicitation for Charity Act," 225 ILCS 460/1 et seq., and such statute as it may hereafter be amended.
(7)
A written statement from the Internal Revenue Service that the organization is a tax exempt organization under the Internal Revenue Code of the United States, section 501(c)(3).
(8)
Where the solicitation will be conducted on streets or highways a certificate of insurance issued by an insurance company licensed to do business in the state shall be provided, insuring the solicitors and their organization and the village, its officers and employees for liability for damages for personal injury and property damage causally related to the acts of the soliciting agent. (c)
Entering traffic intersections for purposes of solicitation. Nothing in the foregoing sections shall be construed to give permission to any solicitor to enter into traffic intersections for the purpose of soliciting in contravention of any state or local ordinance prohibiting such intersection solicitation.
