Chapter 14. BUILDINGS AND BUILDING REGULATIONS |
Article I. IN GENERAL |
§ 14-4. Certificate of occupancy.
(a)
No owner, agent or person in charge of a one-family, two-family, multiple-family dwelling unit or structure, or commercial/industrial structure shall sell or allow any person to occupy the same as tenant or lessee or for a valuable consideration, unless such unit or structure shall have been inspected subsequent to its most recent occupancy and determined to be in compliance with all of the provisions of this chapter and all health and building laws and codes of the village, as evidenced by a certificate of occupancy issued by the building inspector.
(1)
Annual inspections. No owner, agent or person in charge of a nonowner occupied one- or two-family dwelling unit or multiple-dwelling unit or structure shall allow any person to occupy the same as a tenant or lessee unless said unit or structure shall have been inspected once during each year in which the multiple-dwelling unit or structure was occupied and determined to be in compliance with all of the provisions of this chapter, and all health and building laws and codes of the village as evidenced by a certificate of occupancy issued by the building inspector.

Change of occupant. No owner, agent, or person in charge of a nonowner occupied one- or two-family dwelling unit or multiple-family dwelling unit or structure shall allow any person to occupy the same as a tenant or lessee unless said unit or structure shall have been inspected at the time of a change in the person or persons occupying the same, unless said dwelling unit or structure is determined to be in compliance with all of the provisions of this chapter and all health and building laws and codes of the village as evidenced by a certificate of occupancy issued by the building inspector. A valid annual inspection certificate issued not more than six months prior to said change of occupant shall waive requirement of inspection at change of occupant.
(b)
Upon request of the owner, agent or any other person authorized to sell or rent a one-family, two-family or multiple-family dwelling unit or structure or commercial/industrial structure (hereinafter referred to as applicant) the building inspector will be available at any appointed time within two working days agreed upon by himself and the applicant, or later if the applicant requests, to inspect such unit or structure. The term "two working days" in this instance shall mean any two days, during a given week or part thereof, when normal business activities are carried on by the departments of the village. If such inspection establishes that the one-family, two-family or multiple-family dwelling unit or structure or commercial/industrial structure complies with the provisions of this chapter, with all health and building laws and codes of the village, and the requirements of this section, he shall issue a certificate of occupancy for such unit or structure. The certificate shall indicate the date of the inspection; that such unit or structure complies with the requirements of this chapter and all health and building laws and codes of the village; and the maximum number of occupants who may lawfully occupy such dwelling unit or structure under the provisions of this section. One copy of the certificate shall be handed to or mailed to the applicant. A record of all certificates shall be kept on file in the office of the building inspector, and copies shall be furnished, on request, to any person having a proprietary interest or tenancy interest in the building affected. A fee of $50.00 per dwelling unit or commercial/industrial structure shall be charged for each inspection.
(c)
Any person who violates the provisions of this section shall be fined in an amount not exceeding $500.00. The village building inspector shall have the authority to discontinue water service to any residence and business occupied in violation of this section.
