§ 1-2. Definitions and rules of construction.

  • The following definitions and rules of construction shall apply to this Code and to all ordinances and resolutions unless the context requires otherwise:

    Board. Whenever the term "board" is used it shall be construed to mean the Board of Trustees of the Village of South Chicago Heights, Illinois.

    Code or this Code. The terms "Code" or "this Code" mean the Code of Ordinances, Village of South Chicago Heights, Illinois.

    Computation of time. The time within which any act provided by law is to be done shall be computed by excluding the first day and including the last, unless the last day is a Saturday or Sunday or is a holiday as defined or fixed in any statute now or hereafter in force in the state, and then it shall also be excluded. If the day succeeding such Saturday, Sunday or holiday is also a holiday or a Saturday or Sunday, then such succeeding day shall also be excluded.

    Corporate limits. Wherever in this Code an act is prohibited, declared unlawful, required to be performed, directly or by implication, such references shall imply "within the corporate limits of the Village of South Chicago Heights."

    County. The terms "the county" or "this county" mean the County of Cook in the State of Illinois.

    Gender. A term importing the masculine gender shall extend and be applied to females and to firms, partnerships and corporations as well as to males.

    ILCS. The abbreviation "ILCS" shall refer to the Illinois Compiled Statutes, as amended.

    Number. Terms importing the singular number may extend and be applied to several persons or things, and terms importing the plural may include the singular.

    Oath. The term "oath" shall be construed to include an affirmation in all cases in which, by law, an affirmation may be substituted for an oath, and in such cases, the terms "swear" and "sworn" shall be equivalent to the terms "affirm" and "affirmed."

    Delegation of authority. Whenever a provision appears requiring the head of a department or some other village officer to do some act or perform some duty, it is to be construed to authorize the head of the department or other officer to designate, delegate or authorize subordinates to perform the required act or perform the duty unless the terms of the provision or section specify otherwise.

    Officers, departments, etc. Officers, departments, boards, commissions, committees and employees referred to in this Code shall mean officers, departments, boards, commissions, committees and employees of the village, unless the context clearly indicates otherwise.

    Or, and. "Or" may be read "and," and "and" may be read "or" if the sense requires it.

    Owner. The term "owner," applied to a building or land, shall include any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety of the whole or of a part of such building or land.

    Person. The term "person" shall include and be applied to associations, clubs, societies, firms, partnerships and bodies politic and corporate as well as to individuals.

    Personal property. The term "personal property" includes every species of property except real property.

    Shall/may. The term "shall" is mandatory, the term "may" is permissive.

    State. The terms "state" or "the state" shall be construed to mean the State of Illinois.

    Tense. Terms used in the present or past tense include the future as well as the present and past.

    Village. The terms "the village" or "this village" shall be construed as if the words "of South Chicago Heights" followed it and shall extend to and include its several officers, agents and employees.
